Journal:Silver's Investigation Report Delayed

Silver's Report Delayed
This will drag out to the end and hopefully the results of this investigation is not a surprise to everyone. The voters would like an answer and conclusion to this matter before the election. If a special meeting is called, it will be interesting who will support or denounce such an action.

This needs to come to a conclusion, and the City needs to stay out of the business of buying and rehabilitating private property with taxpayer's money.

I hate that this keeps getting tied to the election, what difference does it make if it is before or after the election, it should not be political. Nelson wants it just before the elction so he can take credit for it and maybe salvage some votes. We need to understand the terms of Scorria's contract, when does it renew, under what conditions does he get his severance. There is no way he will resign he would be an idiot to,he would lose his severance which I would guess is around $50,000. I hate the idea of giving him a single penny more then we have to. It would be really great if one of the council members could explain the different scenarios regarding his departure, we all know he has to go, what is the most economical way to get rid of him? How do we transition? Who will take over negotiating pending projects? Best case scenario is that Silver finds cause then he goes without costing the city more money. It would be in our best interest to take the politics out of this situation and make good decisions for the city, not for votes!!!

Mr. Morley, you stated in the a previous blog that you want to call a special meeting so that you can get rid of him ASAP. Can you answer any of the questions to my post above. If you are anxious to deal with him I would assume you know the answers to these questions? I would think that the council members have discussed the economical ramifications of firing Scorria with or without cause or if it would be better just to not renew his contract. A straight forward answer would be very much appreciated.

I did not push for a special meeting in a blog. I did it in the newspaper. I will try my best to explain possible scenarios.
1) Andy is not going to show cause for us. We will have to do that ourselves. Andy will give us facts, we have to put them together.
2) We gave Andy a list of questions to find answers to. Hopefully that wil be done, and will help us in our decision-making
3) Now for the scenarios.
A) If we outright fire Art without cause, we are obligated to pay him 6 months pay and benefits.( Health insurance) The pay amounts to about $50,000. Of course he will also get unused vacation and personal time.
B) If we have cause, and decide to fire him, he has to appeal the decision within five days. He will then have a hearing between 15 and 30 days after his suspension. The hearing board is the City council. After the hearing he is either again the City Manager or he is done. If done, his pay stops at that point. And he is entitled to nothing more except unused vacation and personal time.
I hope this helps explain things. If you have any more questions either ask here or call me. I'll do my best to answer them or find out what I can for you.

This is not Mike - but it would be nice as in the past the council could sit down with an Attorney and discuss things.Remenber when Wears was always present to answer Questions? But the way Art has twisted the internal works of city hall and poisoned the council - This is a totally disfunctional bunch - Art thrives on this - No cooperation- lack of control or mis-directiion a fungus will survivelike Art. Art is a divide and conquer person!

How does his contract work in regardts to renewal? Does it automatically renew, if so when? Do you need grounds not to renew it? How does severance work in that scenario?

His Contract's renewal date is 2/1/12. UNless we do otherwise, it will automaticaly renew at current rate. I have to question his current salary because at last evaluation no raise was approved, yet, he got one.

Yes, lieing to council is grounds. Withholding information is also.

A few years ago their was a murder on NYAve.. District Attorney GAry Niles rushed to judgment to gain votes in an upcoming election.. The proof wasnt there at that time.. Nicole Duve tried the case and it was a conviction but later overturned.. She hadnt presented some of the evidence that was important so the jury got hung.
I see in the paper today Mr Oxley was offered a plea bargain with a guilty plea he gets time served..

Wow.. Point is dont rush to judgment too soon without all of the facts

Just think - if the Mayor and council could get legal advise from an attorney.All our Questions would be answered! Our so called Attorney and Scorria are rubbishing threw documents they wrote and created! What is the attorney suppose to do...come back with doucments that have both their names on them.They worked together on these projects.. created bills of sale...rental leases...etc.Come on people " fox guarding the hen house"Silver and Scorria need happy ending for all!( should we have the two sign another secret Pact)Silver should step back out of the picture and indpendent people step in!

I have never heard one dishonest remark from or about Andy Silver. He comes from a family that prides themselves on being honorable men. We hired Andy to do a job and until he finishes that job let's reserve judgement, lets assume he will do his job honorably. Its so easy to take shots from the sideline. But Andy has a man and his families future in his hands, I for one am glad he is approaching this with due diligence.

Mr Silver is above reproach period !

You have no basis on which to criticize his actions in this case. IF YOU were the ONE being held in question you'd want the full extent of the investigation to be completed NOT a RUSH to Mob justice but rather a complete and detailed review .

I do not like what has gone on and want THOSE responsible at ALL levels to be held accountable .


Moreover I will not be voting for this mayor under any circumstance he has lost my confidence long BEFORE this fiasco .

Anon 8:32 I would like to know what you do you a living? In the real world contractors, engineers and yes even lawyers give you a timetable for completing a project...some times it is not right on schedule. I prefer the guy that dots all his i's and crosses all the t's. Then I am not setting myself up for a lawsuit. Andy Silvers job is to protect the taxpayers from litigation. Let's not assume he is in Arts pocket unless he proves that he is, from everything I know about him he is beyond reproach. This really is starting to look like a lynch mob, get rid of Art...but be smart about it.

Yup.. I cant tell what is taking him so long.. God people mike Morley and Bill Nelson both read the reports and made up their mind within one half hour.
It took Nelson less time then that to get his supporters on this site... Guess what.. He got Rosie waffling.. Rose wants the city manager gone so bad he studders when he writes. He is spreading rumors about McGrath saying he wont fire Sciorra... I believe McGrath is not committing himself to anything but honesty and integrity right now.When the facts and all the facts are weighted I,m sure Jack will do the proper thing not the mob thing and a rush to judgment.

You also have not commented on how we will transition ongoing projects if Scorria is fired. Is there a plan or is this a shotgun approach like Nelson took when he called for his resignation before the investigation was complete. Nelson isn't worried about whether or not General- Propulsion is real or not, or ir there are any other potential job possibilities in the works. Don't get me wrong, I think Scorria should be gone...but it should be dealt with professionally not ad hock because of the election...we have to protect the city from a wrongful termination suit...we have to make sure that nothing of sustenance slips through the cracks in the hoopla!!! Mr. Morley please respond!!!

I will state that what I tell you may not come to pass. I would terminate Art's contract by firing him with cause. Otherwise his contract is open ended, meaning it continues until it is terminated. I would replace Art with Phil, who is knowledgeable about all the goings-on of the City. Phil would be replaced by Tim, who has been second in command for a number of years. Of course, I am only one of six, so none of this may happen. It is all supposition because we do not have Andy's report, and Council has not voted on what to do. Art may actually have enough support on Council to survive. I do not count votes before discussions.

The voters want to know where the candidates are when it comes to their vote. I am sure Mr. Silver will do a great job reviewing all documents and his report will be conclusive and to the point.

It will then be up to the councilors to do their job.

Heh Poly.. Off the subject of the blog I read todays comments from Cathy Streeter and Ms Rupp about the Clerks race in November.
Gavin Regan cut some overhead thus costs for the department.
Mary Rupp said she too cut a deputy job or rather just didnt fill it to save money
Mary Lou Rupp is sstretching the truth to the limits.. She immediatley attempted to fill a position and was denied by the legislators, she had given a leave to an emplyee who left to start a new job somewhere and wanted the legislators to fill the position. She apparently had told the emplyee go try out your new job if you dont like it you can come back here.. Legislators refused this one also not wanting to chance laying off a replacement...
Janet Kelly got called just what she is in another letter today also by DMV employee .. The employees of the County certainly dont want Rupp back as REgan is much more efficient and personable than Rupp..

I've read the comments and have this to say. The Mayor and Mike Morley have lied to taxpayers in the past they continue to violate the city charter and so on. I'm not a fan of Art. But Art is not the only one involved here. Pill. Cosmo is the comptroler and in charge of the cities monies. So why did he let the money out with out questioning it. And lets not forget that Marty Murphy has spent alot of time with individuals at city hall in person and by phone.Maybe it's time to get rid of all of those who have dirty hands in this. If the mayor spent more time in the city he might figure out what's going on. But he's to busy taking care of the family farm in Lisbon. Just because you own a home in the city doesn't make it your resisence. Right mister Mayor?I will say this about Art he micro manages way to much .As for Andy Silver maybe he should of stepped down from this. In the past even thou the city had an attorney they have hired outside attorneys represent the city.

So Mr. Sciorra has allegedly lied to the newspaper. That doesn't sound like grounds for termination to me. Show me where he did something illegal or lied to the city council and I'll get on board, but I think we should save ourselves the headache of litigationa and/or paying severance and just let the guy retire. He may be a jerk, but he hasn't broken any laws.

It now becomes very obvious that Mike Morley and Nelson were playing politics from the begining of this entire affair and Uncle Art and probably Vaugh are doing their part to get Nelson re-elected.
In all likelhood an independant will drop the blame on Woods and try to slip away..

The sad part in all of this is what it will do to the city's future for securing grant money for anything. While the mayor is keeping this all red hot in a last ditch attempt to hold on to his seat, the city is being put under a microscope. How do we secure grant funds when we are basically advertising to the state that we don't know what to with it once we get it. It is sickening to watch, it is very clearly a political dance and no seems to care that audience is the rest of the state and we are the clowns.

Here are some Facts : Obvious Major mess- ups in this grant program ,apparently no one steps up to the plate to accept responsibility , apparently multiple blame games appear to being played , no leadership being displayed , delay , linger & wait CYA game being played till after the election perhaps .H'mm

Now after waiting 2 plus weeks for an atty's report, some on council want an independent investigation ( a good idea BUT w should have been done right away ).

In the meantime taxpayers either thru the grant $$ or other means are footing the bill for this.

Ogdensburg is looking foolish to outsiders and perhaps any future funding agencies.

Sorry but i guess if it looks like a Duck, Quacks Like a Duck and behaves Like a Duck ==Must be a Duck .

Yes I favor the opponent based on the research I have done, his resume is extremely impressive. Honestly I think the city is fortunate to have someone with his background step up to the table and offer to do the job. Those are my reasons for who I support..

I wonder if anyone realizes that maybe Nick was just disgusted with the what and why Nelson & Morley were doing what they were doing. Nick is a young republican who obviously has political ambitions himself...many believe he helped get Nelson elected last time around. Is it possible that he is just so disgusted with the degree of unprofessionalism that occurred in the city in regard to this whole mess that he is speaking out for the principle. Bill Nelson has been Art's protector, he has stuck by him through thick and then defending him. He only abandoned him when he realized he had a real competitor for his seat. Nelson ignored the charter, broke the charter,bragged about it and because he thinks it will win him votes interfered with an investigation in violation of the charter. I truly believe Nick believes in following the policies written by our government and is disgusted by a man he once beleived in. I give him credit for having the balls to call Nelson and Morley out. I don't believe for two seconds that Art is pulling his strings...he believes in the process. Good for you Nick.

I am not a supporter of anarchy.. The Charter should be the guide always. Art should be replaced, Nelson should be replaced and we should choose new councilors that will work within the guidelines of the charter to move the city in a new economically strong direction. I want Council members that are frugal with our money, who do you think is going to pay for outside council and how much will it cost. Cooler heads would have waited for the report and then if they beleived it was not an honest report we would have no choice but to spend the extra money. But the bottom line is Nelsons seat was at risk and he made a desperate move with no concern of the fallout. Due diligence should be the order of the day....it's really disheartening.

I don't like Nick Vaugh very much and I hate the tactic of using auto-calls, but I agree with his message whole-heartedly. At least one council member is standing up for the rule of law.

People on here give Dan Skamperle a hard time when all he is doing is his job as it is stated in the charter. Same thing with Storm Cilley and Mike Powers.

The two who are out of line are Mike Morley and Bill Nelson, and they should be ashamed of the chaos and hatred their political tactics have stirred up. This is how people got killed in the old days. If they keep this up for much longer, people will start coming to City Hall with torches, pitchforks and ropes.

We all need to calm down and approach this issue with some intelligent arguments instead of paranoia and knee-jerk reactions.

I am disgusted with the tactics being used by the Mayor and that Mike Morley is allowing it and even supporting it, I thought he was a man with stronger convictions than that. How do you make people understand that this circus puts us at risk of losing future funding for worthwhile programs. I don't support bad behavior from anyone representing the city and I think and I thank the council members who at the very least tried to point out that they were out of order.

You question my motives for calling for Art's resignation. You think I do it for political gain. The truth is I am only doing my job the way I see it needs to be done. You call me rogue for taking a stand. I read some of the documents that Andy collected. After doing that I asked the City Manager to resign. I must have had a reason to do that. What do you think were in the documents I read?
I try to do the job that I am elected to do. One of those jobs is making sure we are getting the truth from our Manager and Department Heads. If I, and you are not getting the truth, then I must act to correct it.
You say I did a bad job keeping track of the housing program. I agree. And I took responsibility for my inactions in a previous post. And I apologize. The truth is I voted against doing housing rehab in this manner. The vote was 6-1 in favor. It's on record for those who wish to check. I could see us losing control by putting the program in outside hands. Not only are we pouring money into houses that should have been demolished, but we have allowed these people to act as sellers of property. This is against the Charter. I have been yelling about this for months to no avail because Councilors like Vaugh and Skamperle think the Manager can do no wrong.
I don't mind taking criticism for things I do wrong, but when I do things right, like call for the Manager to resign, don't write lies about me.
Why don't you identify yourself so that I can know my accuser, or don't you have the fortitude of your beliefs to stand up? Why do you smear me with no fear of retaliation? Are you working for Art, or Nick, or a political camp?

Why does Mike Morley seem to think this issue is all the City Manager's fault, while Nick Vaugh thinks it is all the City Planner's fault? One or both of them are over-simplifying the issue and/or putting the blame on the wrong person.

Nick Vaugh's statement is impossible to read. Is this the sort of expository writing they're teaching at Clarkson? At least Mr. Woods's statement was comprehensible and literate. And why is Mr. Vaugh releasing public statements when he's urged his peers to defer judgment until the release of Atty. Silver's report? I guess he got tired of being excoriated solely by Mr. Morley and Mr. Nelson, and thought that he might add Mr. Bean and Mr. Cilley to his list of enemies.

Let us get one thing straight - people are accusing Vaugh and others of violating executive session rules. There is no law or rule that says members of a decision-making body can't talk about the content of discussions in executive session. It is public information and can be spoken about after the fact without any risk of criminal prosecution. The only kicker is that councilors need to be careful they don't say anything that might make them the subject of litigation. Executive session does not mean 'secret' - in fact, conducting government affairs in secret in any way IS a violation of state and federal law.

The Blame is that Both Scorria and Woods were lying . They had a secret pact when parting ways its in the news. Nicks information is good and Morley is lied too! When Scorria / Woods/ Vaugn are gone its over!

No, Anonymous 10:07, it is not over. The city council is still made up of a majority of the people who allowed this to happen. Even though Mr. Morley seems intent on doing the right thing now, we can't simply forgive his lack of oversight. To be a good public leader, you have to be intellectually curious enough to make sure the city is being run correctly and the public trust is upheld. Mr. Morley has admitted he failed in his duties, and therefore he should forfeit his position. Shame on all of them, and shame on Ogdensburg for voting in such irresponsible people. Their failures are our failures.

You may have misunderstood what I said. I asked about the housing program once a month for over a year. I admit the answers I received were less than satisfactory, but I did ask. I was not derelict in my duty; I was just unable to get the truth. If you were at all aware of what has been going on for the last year, you would know this. Mr . Morley like it or not is Scorrias boss. The rest of the council is Scorrias boss. So you think it is oK to lie to them and say different things to different people.. 7 Bosses given ... conflicting stories ...to suit Scorrias opinions and leave out certian facts to different people! For just one second put your politics aside. Think about the Taxpayer. Do as Morley said recall him. Good Luck Spend $ 1500 on robo calling . you carry ZERO support. So Mr. Sciorra is the city planner's boss and is thus responsible for the problems with Ogdensburg's housing programs.

Mr. Morley and the council are the city manager's bosses, but they bear no responsibility for Mr. Sciorra's many issues?

Let's get some damned consistency here, people - either you want Sciorra and the Mayor and Deputy Mayor out, or you want none of them out. Otherwise, you are being a hypocrite.

Mr. Morley you say you asked every month for a year? Where was the Mayor in all this...he didn't support you until he started campaigning and started being told by his constituents that they wanted Scorria out, only then did he listen, so the bottom line is that this is political for him and now it has become political for you. Bill Nelson was the city managers protector until he thought it could cost him the election. He needs to go.

We never had this kind of grant mismanagement until it was micromanaged by the city manager, creation of a city planner, and subcontracting the administration of city grants by a private sub contractor. Too many hands in the pot that never read the CFR.

Art used you ,city workers,city officals and dept heads.. enought with his reign of terror. This pro McGraph supporter and Uncle Artie would get together just fine... their reason and tactics are the same. Good luck to you and the council -put us on the right path!
