Journal:Sewage Fees At Heart Of Dispute Cheese Plant, City Officials Disagree Over Who Is Responsible

The battle over sewage charges between Ogdensburg and the City ultimately led to the plant's closure again.  The ongoing problem is over charging the cheese plant for sewage fees due to storm runoff entering the cheese plant's sewage system.  Prior owners made claim to this, M. Bistritzky, co-owner claims that testing done by the OFD proves his statement. 

In the past dye had been poured into an old storm drain which ended up in the cheese plant, and ultimately in their sewage system.  Art  J. Sciorra can delay and continue to deny the claim but we lose the cheese plant jobs again.  Prior owner, Tubroburg LLC stated the same problem.  The City gained ownership of the cheese plant after a foreclosure.  This is another example of the city owning and managing private industry.  We would think 30 jobs would be worth working out a solution. 

This has turned into finger pointing...who is responsible for fixing the problem.  The City and the Cheese Plant have an interest in solving the problem.  Art said the property was sold "as-is", and if the City is not willing to will to assist or rectify an old problem, they will get the property back AS-IS.  Then the City would have another 800 lb gorilla sitting idle, not paying taxes, and 30 more jobs gone.

The kicker is that plant is closed and it is still discharging sewage!

Typical City bull----, The city has had this type of problem consistantly over the years. Remember the big set to on Morris st when a city forman gave some advise to a local taxpayer and it was wrong advice and ended up costing the city a lot of money. Last summers event on Montgomery st will end up costing the city thousands and ended up with the city retaliating in harrassment of Mr. Rose. Then Mr. Wells complaint on Hasbrouk st about a local business being allowed to operate in a residental district but not pay commercial rates on water and sewer rates. Thats still going on. Why? She bought out council or the majority I should say.
This compalint has been made since that plant went back into operation but the city has done nothing to help this buisness.. Councilors like this Vaugh want their picture in the paper all the time with all this spin and bs they spew from their mouths but when it comes to doing something for someone business included they just sit and go with Nelson and the status quo.
This city has got to get out of this gutter they are in. The voters have got to make their message clear in November and vote for a new mayor and certainly reject Vaugh and Powers and any other that stands in the way of progress. If Sciora fails to get this plant operating in the next month he should be fired period end of satatement.

Simple 903.. We pay Scioras wages, we pay Nelsons wages and the councils wages. We pay all their wages. If they fu-- up we pay for their mistakes. If we complain we have to go to city hall and stand in front of council and the mayor sets his five minute rule, the council sits back and yawns oh hum. Then business goes back on with no other thought given to our problems.
We as taxpayers are ultimently at fualt for letting people like you mentioned lie to us and get voted in then continue to lie for their entire term.

If they bought this plant as is thats another story. My understanding of the issue howerver is that disclosure on problems has to be made. If this was made properly and they bought it, Tough. If the disclosure was false or inaccuraate then the city should be responsible. The previous owner had complained as you stated so obviously they should have been aware of some problem so I have to believe the citys claim of AS IS is void.

What difference does it make whos fault it is. The big thing is what can be done to fix the problem and get the plant up and running again.
The city dosnt need to keep their nose in issues other than government and compete with local business men in any way
