Journal:Three More Oxley Jurors Get Selected

We Already Know
With the Oxley trail underway...except for Wayne, Nicole, and Jerry is anyone paying attention this time? How can they find a juror that has not already made their mind up on his guilt or innocents in this County? If that is the case, I believe we will have another mistrial with a hung jury.  Unsolved murder is getting to be a common story line in Ogdensburg.

Not to much to comment on here. Oxley was found guilty of murder some time ago.. Only thing was Jerry Richards played D.A. along with Duve during the case and allowed this guy to slip through the cracks with an appeal.
The second trial brought confusion and in the end some jurors were unsure.
If Duve is a prosecutor she will convict him this time. If not she needs to be replaced

In her defense, she was stuck with the case by Gary Miles the former DA who rushed to judgment without the proper evidence. Evidence was questionable at the least but the authorities lied and made mistakes, a very volatile combination.. The Simpson trial was full of these type of things causing the jury to be confused and have a doubt..
I,ve said it more than once, cops who lie or exagerate the truth to exploit an arrest need to be charged with a crime and prosecuted. Its becomeing epidemic in the North Country. This is part of the reason the crime rate is so high up here, the criminals know the system is weak starting with the cops. They dont know how to investigate, they would rather do things quickly, easily without any effort, womanize a little with little or know recourse then lay back and draw a heafty pension from the taxpayers..
Yah. he will probably go free but for sure he did it...

Let's be serious a second. Wayne Oxley did it and thought he could get away with it and used his little posse of criminals and thugs to intimidate witnesses and lie through their teeth on the stand. Some of his witnesses actually admitted on the stand that they were high.
In the U.S., even the guilty have a right to attorneys and to offer a defense at trial. Wayne's attorneys did a superb job of muddying the waters and convincing some people that maybe African American drug dealers from out of town did it.
A lot of foolish people in Ogdensburg bought the idea because it scares them to think that someone they've met before could commit a savage act. Of course a lot of them would have also told you before the fist trial that Oxley wasn't a crack addict.
Gary Miles didn't "rush to judgment." All the evidence he came up with was used in the trial.
The Ogdensburg police did not lie or exaggerate.
If you check, you'll discover the Major Crimes Unit of the New York State Police and their forensic team did the evidence collection at the crime scene and worked hand in hand with city police. To the credit of the city police, they brought in the State Police at the very beginning of the investigation to handle all of the crime scene analysis and to work with their investigators during the investigation.
On TV crimes are solved in under an hour, all criminal admit they did it and everything gets wrapped up in a neat package for the jury. In real life, it's not that simple and defense attorneys go to elaborate lengths to confuse jurors about the reliability of DNA evidence.
There was nothing wrong with the DNA evidence, the defense just did its job of making it look like there were reasons to doubt it.
If you checked the facts, you'd find the Ogdensburg police did not do a thing during the Oxley investigation that did not have the Major Crimes Unit's blessing.
That's not meant as a criticsm of the major crimes unit, the DA or the city police.
The reality is that city police are easy targets for criticism, but in real life, if someone like Oxley acts alone, late at night and no one sees him do it, and he refuses to admit he did it, police and prosecutors have to use circumstantial evidence.

And its up to the DA to use the major cimes units evidence and link him to the crime..
Intimidating witness is a stretch when the DA had her investigator stage and arrest ib one of his witnesses in front of the jury at lunch time. What about Kevin Fees statement he alledgedly got from Mike Morley placing two blacks at the Scene or near it.. Kevins statement didnt indicate that did it.. When Oxley yelled at the husband of a local attorney that he needed an attorney but was ignored by the DA. DA said he was kidding but the troopers around him said they didnt hear this..
Oxley was the target from the begining and the attention on others was minimul to say the least. Its obvious your a cop protecting your job, but we as taxpayers deserve the protection not your jobs. If the State Police are near then we should call them in other words. The arrest of Oxley should not have happened for days not in hours...
I to believe he is guilty as sin but jokers like you are the reason hes going to go free again.

Lets get to the heart of the above comments.
Trickey murdered no conviction
Shannon murdered no conviction
Lawson murdered no conviction
Small child murdered on hasbrouk st in fire years ago.. No conviction as local police Sgt lied on stand and his report
Woman murdered at Stae hospital Two arrested.. Both sentenced to prison for manslaughter.. One released when found out Ogdensburg Police LT lied about miranda to him...
This entire affair with Oxley says it all about the Ogdensburg Police force... Their training seems to be lacking over the years. Their honesty has really come under scruitany over the years. When was the last major drug bust I mean major one in the Burg... Local Officer arrested for breaking into a burgalizing several businesses in the early eightys.. In the early or late sixtys another arrested for breaking into businesses.. A just retired Lt. gets arrested for larceny in AMes store.. A local St get arersted for aggravated assault on his wife... It goes on and on folks..
Story is true and I missed some.. Always been a lack of disipline in this dept and always will be...

What about the Monroe boy.. Drowned over drugs.. No conviction because of incompetant police work.. Guy that did it went to prison over an assault.. He laughs daily about the local cops from his home where he is still selling drugs. Local police have informant or two on force that get paid to provide info to drug dealers on pending aciton on them... Thats a strong street rumor.. Old man on Ford Ave selling amd growing MJ for years and pays a cop for inside info...

Duve is the DA that let the "Gas Thief" from Jefferson Co. go unpunished by forgetting to investiagate, Seems odd, now we have the person who stole from his employer referred to St. Lawrence Co. for prosecution, this along with PattyPlate makes St. Lawrence Co. the laughing stock of the State.

If I had the time (full time mother of two young kids) I could have been on that jury. I've avoided anything written about it until the past couple of weeks.
